ARTICLE L.121-16 AND ORDINANCE N° 2001-741 OF 08.23.2001
The present general conditions of sale apply exclusively to all sales concluded within the
framework of our website: www.mve-france.fr as well as the sales concluded through any
catalogue or leaflet of our products.
These general conditions of sale may be modified at any time; the applicable conditions are
those in force on the site on the date the order is placed.
ARTICLE 2
ARTICLE L.121-18 MENTIONS OF PRIOR INFORMATION
Orders and order validation
– You can place your order on the internet website: www.mve-france.fr
– By post: Mad Verre & Equipements – 1 B rue du cul de sac – 54890 WAVILLE. Your order will
then be shipped upon receipt of your payment.
To be accepted, your order will have to carry all the useful indications for its processing, as
presented in the order form.
After having ‘Validated’ your order, this one is transmitted to Mad Verre & Equipements for
processing and preparation and represents a full and entire acceptance of the present general
conditions.
The data including the civilities: name, address, content, date and amount of the order will serve
as proof of the sales contracts between the customer and Mad Verre & Equipements and towards
third parties.
Mad Verre & Equipements reserves the right to cancel any order from a customer with whom there
would be a dispute concerning a later order.
After having placed your order, we send you an e-mail confirming the elements of your order.
This e-mail constitutes our confirmation of your order and thus forms the sale contract between
Us and You (YOU AND US). It will also include the Colissimo tracking number, allowing the
customer to follow his parcel and to seek redress if necessary.
In case of order by mail and payment by check: you must print the screen summarizing your
order, attach the payment and send it to us by post.
If you do not have a printer, you can simply send us your complete contact information on a
separate sheet of paper, or fill out the order form from one of our catalogues and send it with
your signed check – payable to Mad Verre & Equipements – in a stamped envelope at the current rate.
The sending of cash is not recommended. The customer remains at all times responsible for such a
shipment and its security. Mad Verre & Equipements cannot be held responsible for any loss or theft
during such a shipment.
ARTICLE 3
PRICE, AVAILABILITY AND DELIVERY.
3/1 The prices displayed on the website are indicated in euros all French taxes included (VAT not
applicable Article 293b of the General Tax Code), except participation in the carriage costs, the
expenses of treatment of your order and the packing costs.
The price is payable in full and in a single payment at the time of order.
Mad Verre & Equipements reserves the right to modify its prices at any time, but the products will be
invoiced on the basis of the rates in force at the time of the order, subject to availability.
If you choose to pay for your order by bank check, it will only be processed upon receipt of your
check and the applicable delivery times will be those on the day of receipt of the check.
3/2 Information relating to availability may be subject to change and are given for information only and
in no case can we guarantee these deadlines.
In the case of payment by credit card, the payment is debited only at the time of shipment of your order.
Consequently, in case an item is not available and no replacement item could be offered to you, your
payment card will not be debited for the amount of the missing product(s).
3/2 Delivery – Article L.121-20-3 order processing time and liability
Unless the parties have agreed otherwise, Mad Verre & Equipements must execute the order within
thirty days from the day following the day on which the consumer has transmitted his order for the
product or service to us.
The products are delivered to the address indicated on the order form. The purchaser is required to
check the condition of the packaging and of the merchandise upon receipt of his order and is required
to report any damage due to the carrier on the delivery note, as well as to Mad Verre & Equipements
upon receipt.
Shipments are entrusted to a private carrier (see ARTICLE 6 concerning delivery).
Mad Verre & Equipements is automatically responsible towards the consumer for the proper execution
of the obligations resulting from the contract concluded at a distance.
However its responsibility cannot be engaged, because of the inexecution or the bad execution of the
contract in case of: an unforeseeable and insurmountable fact, a case of force majeure: strike, civil or
foreign war, riots, acts of terrorism, total or partial destruction of premises and production facilities or
others, manufacturing incidents, disruptions in transport, supply difficulties, customs measures of any
nature or origin whatsoever or any other fortuitous event which prevents or delays totally or partially the
execution of the contract obligations of Mad Verre & Equipements.
Non-refund and non-return of custom orders : products made to measure are neither refundable nor exchangeable.
ARTICLE 4
RIGHT OF WITHDRAWAL – ARTICLE L.121-20 AND ARTICLE L.121-20-1
In accordance with article L.121-20 and following of the Consumer Code, the customer has a period
of 7 working days from the delivery date of his order to return any item that does not suit him and
request an exchange or refund without penalty; with the exception of return costs which remain the
responsibility of the customer, the PayPal and/or Stripe transaction fees will also be deducted from the refund amount. The customer must then return the package by Colissimo with tracking.
When the seven-day period expires on a Saturday, Sunday or a public holiday, it is extended to the
next working day. Glasses and glasses clips are neither exchangeable nor refundable.
When the right of withdrawal is exercised, the supplier is required to reimburse within 30 days following
the date on which this right was exercised.
Right of Return : Before returning any product, you must contact us in order to assign you a RETURN
number. The product must be in perfect condition, in its original undamaged packaging. No cash on
delivery will be accepted.
ARTICLE 5
PAYMENT
-Payment by bank transfer to our bank CIC.
-By secure Stripe payment by credit card directly from our website.
-By secure PayPal payment from a secure page.
-By bank check: your order is reserved during 7 days; after this period and without receipt of your check
the order will be cancelled. The order will be processed only upon receipt of the check.
The check will have to be made out to the order of : Mad Verre & Equipements and sent to the address :
MVE – 1 B rue du cul de sac – 54890 WAVILLE.
-Orders and transmitted banking information are secured by a SSL encryption process that offers
maximum confidentiality of data transmitted via the Internet. This process is reinforced by internal and
external security systems protecting the so-called sensitive data. Your credit card data will only be known
by our partner bank.
ARTICLE 6
DELIVERY
Our delivery times are indicated in working days as an indication and are to be considered once the order
has been validated. A delay in delivery can in no case give right to any indemnity or penalty whatsoever.
We invite you to notify us of any delay in delivery of more than seven days to allow us to start an investigation
with the carrier. Investigation delays may vary from one to three weeks, depending on the carrier. If during the
investigation period, the package is found, it will be forwarded immediately to your place of delivery. During this
investigation period, no refund, credit note or return of replacement goods can be made.
By express agreement, a case of force majeure preventing delivery cannot be imputable to Mad Verre &
Equipements. The following are considered as cases of force majeure or exceptional events by law: LOCK-OUT,
strike, total or partial work stoppage at Mad Verre & Equipements or at its suppliers or service providers, epidemic,
war, requisition, fire, flood, interruption or delay in transport, legal or administrative measures preventing,
restricting, delaying or prohibiting the manufacture or import of the goods, etc. The Seller is released from all
liability upon delivery. The Seller will inform the Buyer in a timely manner of the cases and events listed above. In
all cases, timely delivery can only occur if the Buyer is up to date with its obligations to the Seller.
ARTICLE 7
RESERVATION OF OWNERSHIP
The products remain the property of Mad Verre & Equipements until full payment of the order.
ARTICLE 8
PRODUCT WARRANTY – LAW N° 98-389 OF 05.19.1998
The consumer is informed that Mad Verre & Equipements is not the producer of the products sold in the context
of its Distance Selling Shop. In accordance with the measures of Article n° 4 of the decree n° 78-464 of the
03.24.1978, these cannot deprive the consumer of the legal guarantee which forces the supplier to guarantee it
against the consequences of the hidden defects of the sold article.
Consequently, in case of damage caused to a consumer or a good because of a defect of the product, only the
responsibility of the producer of this one will have to be sought by the consumer, on the basis of information
appearing on the packing of the aforementioned product or on the documentation provided by the producer.
The comments, indications and all information released on the Mad Verre & Equipements website, concerning the
products and their use, have as only purpose to provide information and do not in any case represent
recommendations for treatment, whether preventive or curative, a prescription or a diagnosis and should not be
interpreted as such.
It is of course recommended in case of persistent discomfort and/or illness, to consult a health professional who
is able to correctly assess the symptoms and provide the appropriate treatment.
We formally decline any direct or indirect responsibility as to the non-respect of what has just been listed and the
consequences that this could generate for the consumer.
We also formally decline any direct or indirect responsibility for the misuse or misrepresentation of the products.
By using this website you formally acknowledge and adhere to these provisions and our disclaimer of responsibility.
The warranty for the oxygen concentrator is two years for the machine and one year for the sieves.
The resale of our products to a third party voids any warranty.

INTELLECTUAL PROPERTY
Any mention or use of all or part of this Site: mention, name, logo, colour, graphic and design belonging to or
registered by Mad Verre & Equipements is strictly prohibited and may in no case be reproduced, copied, sold or
exploited for commercial reasons.
Under copyright and intellectual property law and in accordance with the French code of intellectual property in
force, only the use of the site for private use is authorized. Any other use will be considered as counterfeiting and
will be sanctioned under intellectual property law, unless Mad Verre & Equipements has given its prior agreement.
It may be granted on a non-exclusive and revocable basis, the creation of a hypertext link to the home page of our
Site, provided that this link does not harm our brand image and the image of our partners present on our site, of
such a nature as to induce loss of customers. On the other hand, the creation of this hypertext link does not
engage our responsibility for the content of your site.
This requires our express written authorization.

APPLICABLE LAW AND JURISDICTION
The present general conditions of sale are subject to French law.
ARTICLE 11
BUYER’S ACCEPTANCE
The present general conditions of sale as well as the applied tariffs are expressly approved and accepted by the
purchaser who declares and recognizes to have a perfect knowledge of it; the act of purchase entailing acceptance
of the present general conditions of sale.
